AUSD Won’t Respond Regarding Redevelopment Funds

We’re pleased that the Alameda Unified School District has finally decided to claim redevelopment pass-through funds from the Business and Waterfront Improvement Project owed to them but held by the City of Alameda. However, there are other funds from the Alameda Point Improvement Project area that don’t yet seem to be showing up on AUSD’s books. We’ve notified the out-going AUSD board and superintendent, as well as the new supe and CFO, but they have not yet responded to us.

We first contacted the AUSD board about this in spring of 2008 – the board and out-going Superintendent Ardella Dailey have refused to acknowledge the issue, and they have refused to respond to public records requests for detailed budget information so we could try to verify for ourselves if redevelopment funds from Alameda Point are being transferred from the City of Alameda to AUSD.

All of Alameda Point is in a redevelopment area which, according to public records from the City of Alameda and the State of California is generating revenue.

The Alameda Point Improvement Project of the City of Alameda Community Improvement Commission (CIC) is a redevelopment project created post-1998. As such, and in accordance with bill AB1290, and California Health and Safety Code 33607.5 there is a mandatory pass-through of tax-increment funds from the project/CIC to the local school district, i.e. AUSD. It’s a terribly complicated formula that is used to calculate the pass-through amount, but we have identified actual dollar amounts as shown below.

While we can find evidence of the funds allocated on the State Controller’s records (Annual California State Controller’s Report on Redevelopment Agencies) and on the filings made by the City of Alameda (“Statement of Indebtedness”) which are used as input to the State’s report. HOWEVER, WE HAVE YET TO FIND ANY RECORD OF THESE PASS-THROUGH FUNDS ON AUSD’S BOOKS.

From 2004 to 2007, based on the state controller’s report, this sum of money totals $115,470.

Adding in the estimate for 2008-2009 from the Statement of Indebtedness filed 9/11/09 by the City of Alameda CFO, there’s another $50,687 due to AUSD under this pass-through obligation, and the amount for 2007-2008 – not yet available from the state controller’s office until May 2009, but we can estimate from the 2007-2008 SOI filing – this brings the total amount of the pass-through obligations for APIP for 2004 to 2009 to $221,045.

Where has or will that $221,045 landed or will land on AUSD’s books? It’s being allocated on the City of Alameda side in CIC and the finance department, but we don’t see any evidence it’s making it to the schools. Maybe it is and we just haven’t found it yet, but AUSD has been un-responsive to our several requests to have it identified.

The Business and Waterfront Improvement Project also shows a debt of $141,152 owed to AUSD but with no payments being made – AUSD might want to ask for an early collection on that $141,152 seeing as how the schools need the money.
