Kohl’s Asks to Stay Open Later Year-Round

Kohl’s department store at the South Shore Shopping Center will be back before the City of Alameda Planning Board on November 13th with a request to stay open to 11:00 p.m., instead of 10:00 p.m., year-round.

Kohl’s is also asking the planning board to relax use permit conditions that would trigger a revocation hearing.

Currently, the is not permitted to open before 7:00 a.m. or close after 10 p.m. between January 2 and October 31. The store wants to extend that closing time to 11:00 p.m. on Wednesdays, Fridays and Saturdays.

In their report, City of Alameda Planning Department staff look favorably on that request, noting that Safeway, Walgreens, 24-hour Fitness and restaurants in the shopping center stay open to midnight or later under existing permits.

City staff also support Kohl’s request to extend opening hours to 4:00 a.m. to midnight on “Black Friday,” the first Friday after Thanksgiving, and to 6:00 a.m. to 5:00 a.m. the day after Christmas.

However, the report recommends rejecting the store’s request for more favorable conditions regarding complains that might trigger permit revocation hearings.

Kohl’s is asking for changes that would require “two documented violations within a one-month period” to trigger a hearing; city staff are recommending language that would see two violations of the use permit conditions within a 12 month period between January 1 and January 2 of the next year automatically set a date for a revocation hearing.

In 2009, the City of Alameda received various complaints that Kohl’s was opening their store in violation of the use permit. After a public hearing, the planning board modified the use permit to permit longer hours during the Thanksgiving and December holiday shopping season.
