In a community update later released today, Ms. Vital said as much as $7.4 million in school revenue is at risk as a result of a decision handed down earlier this week that ruled a portion of Measure H, passed by voters in 2008, is unlawful. Only the $120 per residential part of the tax was lawful the court said, and not the per-square-foot commercial portion.
The superintendent also reiterated support for 18th Assembly District representative Rob Bonta’s bill, AB59, which would attempt to clarify the law at play in the Borikas lawsuit, to allow districts to charge different parcel tax rates for commercial and residential property.
