City Claims Victory in Gallant Lawsuit

On February 14th, an Alameda County Superior Court judge signed a judgment dismissing former Interim City Manager Ann Marie Gallant’s lawsuit against the City of Alameda.

The City of Alameda is claiming a victory, after Alameda County Superior Court Judge John M. True, III, on February 14th, signed a judgment dismissing former Interim City Manager Ann Marie Gallant’s lawsuit against the City of Alameda for wrongful dismissal.

On February 10th, Action Alameda News reported that a proposed judgment, not yet signed by the judge, was available on the court’s register of documents.

The signed judgment is now available through the court’s website. (Case number RG11590505.)

The City of Alameda was successful in its novel approach of using anti-Strategic Lawsuits Against Public Participation law to strike down Gallant’s claims before they went to trial.

Under this strategy, the City of Alameda claimed that the decision to terminate Gallant was protected free speech.

The judgment dismisses the case with prejudice, meaning that Gallant can’t bring it back to the courts, and calls for the City of Alameda to recover costs, which city officials expect to run into six-figures, from Gallant.

In a prepared statement released to the media yesterday, City Attorney Janet Kern said, “Let this be a reminder that we vigorously defend against all frivolous lawsuits; and that in all cases, we will go after our legal costs.”

However, City of Alameda officials previously confirmed to Action Alameda News that they wouldn’t seek cost recovery in the Raymond Zack wrongful death lawsuit, which the city also defeated.

This morning, Assistant City Manager Alex Nguyen wouldn’t confirm whether or not the city intended to hold true to Kern’s statements and actually seek cost recovery from Gallant.
