In 2010, the City of Alameda adopted an ordinance prohibiting the establishment or operation of a marijuana dispensary within the city. On November 23rd, the Planning Board will consider a recommendation to city council that it adopt an ordinance prohibiting the cultivation of marijuana as well.

The ordinance is needed, city staff say, to prevent a scenario whereby, as new state law comes into effect early next year, “a commercial cultivation operation requests a business license for an inappropriate location in Alameda and makes the argument that the City must issue the business license because ‘agriculture’ is permitted by right and the zoning ordinance does not explicitly make a distinction between agriculture and marijuana cultivation.”

The recommended changes to local zoning include amendments to explicitly define marijuana cultivation and prohibit marijuana cultivation, except for personal use.

The move, staff say, will still allow for Alameda to have a “robust discussion about medical marijuana dispensaries, cultivation, and delivery at a later date when the State’s regulatory structure becomes clearer.”
