The plaintiffs in a lawsuit against the Alameda Unified School District over Measure H, who asserted that the Measure H “split roll” tax is illegal and unfair, vowed today to appeal a trial court judgment that ruled the tax legal.  Earlier this week, the Alameda Unified School District issued a press release suggesting that they were poised to win the Measure H lawsuit over the 2008 parcel tax. David Brillant, attorney for the plaintiffs, issued his own press release today noting that the District has not yet won the lawsuit and, in any event, the plaintiffs will appeal the decision if they do. Last week, David Brillant, attorney for the plaintiffs in the Borikas v. AUSD lawsuit over Measure H filed a trial brief with the court. The case is going to trial and may have impacts on the school district’s newly proposed parcel tax, Measure E. Alameda Unified School District payment vouchers obtained by Action Alameda News suggest that the District’s costs to defend the lawsuits over Measure H have cost well over $200,000 since 2008. Recently, Action Alameda News sat down with Ed Hirshberg, a party to the Borikas lawsuit against the Alameda Unified School District to talk about the case, and property tax uniformity. Note that tonight’s Alameda Unified School District Board of Education meeting will be held at the Alameda High School Little Theater at Oak and Central, due to a special City Council meeting in City Council chambers.
